The Supreme Court has rejected Tonye Cole and the All Progressives Congress (APC)’s appeal against the election of Siminalayi Fubara as Rivers State governor, stating it lacked merit.

Confirming Fubara as the rightful governor, the court ruled that the appellant failed to substantiate claims of Electoral Act non-compliance.

Cole contested Fubara’s victory, citing issues such as Fubara’s alleged failure to resign as the Accountant General and election irregularities.

The court found the appeal incompetent and dismissed it, upholding Fubara’s win in the March 18, 2023 election.

This legal battle originated from the Appeal Court’s November 28, 2023 decision, which lacked sufficient evidence, leading to the dismissal of Cole’s appeal.
