Court Imposes N100M Fine on FG, EFCC for Illegally Detaining Ex-CBN Governor, Emefiele
In a ruling on Monday, Justice Adeniyi went further to restrain the federal government and its agencies from re-arresting, detaining, or harassing Emefiele, irrespective of his ongoing trial, without obtaining a warrant of arrest from a court of competent jurisdiction.


Justice Olukayode Adeniyi of the High Court in the Federal Capital Territory (FCT) has ordered the Federal Government and the Economic and Financial Crimes Commission (EFCC) to pay a substantial fine of N100 million for the unlawful detention of former Central Bank of Nigeria (CBN) Governor, Godwin Emefiele.
In a ruling on Monday, Justice Adeniyi went further to restrain the federal government and its agencies from re-arresting, detaining, or harassing Emefiele, irrespective of his ongoing trial, without obtaining a warrant of arrest from a court of competent jurisdiction.
The judge deemed the prolonged detention of Emefiele for over five months by the Department of State Service (DSS) and EFCC as illegal, unlawful, and unconstitutional.
He criticized the federal government’s explanation that Emefiele was under investigation for other alleged infractions, stating that the detention order obtained from a Chief Magistrate Court in Wuse, Abuja lacked probative value.
Justice Adeniyi expressed dissatisfaction with the security agencies for arresting and detaining suspects before conducting investigations.
