Abubakar Atiku, the presidential candidate of the Peoples Democratic Party (PDP), has lodged an appeal with the Supreme Court, seeking to invalidate the judgment of the Presidential Election Petitions Court that affirmed President Bola Tinubu’s victory in the 2023 elections.
In the appeal, which consists of 35 grounds, Atiku argues that the tribunal made significant errors and a miscarriage of justice in its findings and conclusions when addressing his petition against the Independent National Electoral Commission (INEC)’s declaration of Tinubu as President.
Furthermore, the appeal requests the Supreme Court to set aside the entire findings and conclusions of the Tribunal on the basis that they did not accurately reflect the substance of his petition.
Atiku contends that the tribunal’s failure to nullify the presidential election held on February 25, 2023, due to non-compliance with the Electoral Act 2022, was a legal error.
He points to evidence presented before the Tribunal indicating that INEC conducted the election in a manner inconsistent with the principles of the Electoral Act 2022 and the doctrine of legitimate expectation.
